Wrongful and unfair dismissal and redundancy
Most people end their period of employment amicably without making any claim against their employer. However, if an employee feels aggrieved, they may make an application either to the Employment Tribunal or to the court.
- wrongful dismissal
Wrongful dismissal claims are based on a breach of the terms of the contract of employment.
- unfair dismissal
Unfair dismissal claims are based on a breach of the employee's statutory rights.
- redundancy
An employee dismissed on grounds of redundancy is entitled to a statutory redundancy payment. If this is not forthcoming, a claim can be brought to the tribunal.
Avoiding these claims
It is obviously in your interest to avoid these types of claim as far as possible. In order to do so, you need to have in place well thought-out disciplinary and grievance procedures. It is also worth taking legal advice before deciding to make anybody redundant.
